RELEASE OF LIABILITY:

 

  1. The purpose of MYLF is to improve the overall health, vitality and well-being of the body through nutritional education and the use of natural foods and non-medicinal nutritional supplements. Fit HQ, LLC's MYLF Health Coaches do not diagnose diseases, disorders or conditions.

 

  1. MYLF Coaches are not a licensed Dietitian, Naturopathic Doctor or Medical Physician.

 

  1. As part of the MYLF Coaching Services, I may be asked to provide information concerning my physical habits, medical history, moods, energy levels, likes and dislikes, lifestyle and diet. This information is collected to enable MYLF Health Coaches to: (i) assess my knowledge of nutrition, (ii) educate me about the benefits of sound nutritional practices and (iii) recommend dietary changes to improve my general health, vitality and overall well-being. MYLF Health Coaches will hold this information in confidence and will not release or disclose this information to any other person, without my prior consent, except as required by applicable law.

 

  1. If MYLF Health Coaches suspect the existence of disease, disorder or condition, I will be informed of this suspicion. However, I acknowledge this is not a diagnosis or conclusion about the state of my health and that I am directed to promptly consult a licensed Physician or Naturopath about any suspected problems.

 

  1. Should I request the MYLF Health Coaches to recommend dietary changes and/or nutritional supplements to enhance my body’s natural ability to resist and/or overcome a known disease, disorder or condition, it is my responsibility to disclose the nature of the disease, disorder or condition and all other relevant details to the MYLF Health Coaches. If I have not previously consulted a licensed Physician or Naturopath about this disease, disorder or condition, I acknowledge that I am directed to promptly do so. I am not to alter or discontinue treatments prescribed by a licensed Naturopath, Physician or other licensed health professional without consulting the individual who prescribed the treatment.

 

  1. In providing Health Coaching Services to me, MYLF Health Coaches are relying upon the truth, accuracy and completeness of all information I have provided to them. Any recommendations I follow for changes in diet, including the use of nutritional supplements, are entirely my responsibility.

 

  1. MYLF Health Coaches are in no way liable for my health or safety.

 

  1. In consideration of my participation in MYLF Health Coaching Services, I hereby accept all risk to my health, including injury or death that may result from such participation and I hereby release MYLF Health Coaches on my behalf, and on behalf of my personal representatives, estate, heirs, next of kin, and assigns from any and all costs, claims, causes of action and damages arising from any and all illness or injury to my person, including my death, that may result from or occur as a result of my participation in MYLF Health Coaching Services, whether caused by negligence or otherwise.

 

I understand that any therapies I undertake at MYLF Health Coaching are undertaken of my own free will. I accept that the ultimate responsibility for my health care is my own and tha MYLF Health Coaches are here to support me in this. I understand that my practitioner reserves the right to determine which cases fall outside their scope of practice, in which event an appropriate referral will be recommended. I hereby agree to assume full responsibility for any manner of loss, injury, claim or damage whatsoever, known or unknown, incurred as a result of same and I, my heirs, executors, administrators or assigns for any loss, injury, claim or damage sustained as a result of my attendance and/or participation. I have read the above release and waiver of liability, and fully understand its contents and voluntarily agree to the terms and conditions stated.


TERMS AND CONDITIONS

By signing up for an account, you are agreeing to these Terms of Use of Services (the “Agreement”) entered into between you (“Client”) and FIT HQ, LLC (MYLF Coaching).

This Agreement is a legally binding contract that governs your use of the products and services provided by FIT HQ, LLC through membership in its coaching programs. Please read carefully. By signing, you acknowledge that you have read, understood, and agreed to the terms below.

1. Services

As a member of FIT HQ, LLC (MYLF Coaching), you will be given access to online health coaching services. These services may include:

  • Nutrition and mindset video lectures

  • Access to our platform with a full recipe library

  • Use of our food logging app

  • A workout video library

  • If you selected a program that includes coaching, you will also have access to your MYLF coach, who reviews your daily food logs and provides a virtual response (typed or recorded video) either daily or weekly, depending on the program you selected.

    • Coaching is delivered through review of your logged food and related activity. Your participation-such as logging meals, completing check-ins, and engaging with provided resources-is required for coaching feedback. Lack of participation does not release you from your financial obligation or qualify you for a refund.

Program delivery is deemed complete once you are granted access to the platform, receive login credentials, and coaching feedback is made available to you. Continued participation is your responsibility.

2. Fees and Payment

Payment entitles you to access the FIT HQ, LLC (MYLF Coaching) services for the duration of the purchased program.

All sales are final. Due to the digital and coaching nature of the program, FIT HQ, LLC (MYLF Coaching) does not offer refunds once program access has been delivered (see Section 1).

If you are offered a payment plan, you remain responsible for completing all scheduled payments regardless of whether you participate fully in the program.

3. Affirm and Third-Party Financing

If you choose to pay using Affirm or any other third-party financing option, you are entering into a separate loan agreement with that provider.

FIT HQ, LLC (MYLF Coaching) is not responsible for the terms of your financing, including interest rates, fees, or repayment schedules.

You remain responsible for repaying your loan according to its terms, regardless of your use or completion of the program.

Refund requests made through Affirm or other lenders are subject to this Agreement’s refund policy only, not the lender’s.

4. Medical or Financial Hardship

FIT HQ, LLC (MYLF Coaching) understands that medical conditions, financial hardship, or personal circumstances may arise. However, such events do not void this Agreement or release you from payment obligations. Exceptions may be made at the sole discretion of FIT HQ, LLC (MYLF COACHING) but are not guaranteed.

5. No Third-Party Access

During registration you will create an account, including a username and password, required for access to password-protected or secure areas of the FIT HQ platform. You agree not to share your login credentials, access links, or coaching resources with any third party. Sharing constitutes a material breach of this Agreement.

6. Audio and Video Release

By participating, you authorize FIT HQ, LLC (MYLF COACHING) to use your voice, photo, likeness, and/or testimonial for promotional or marketing purposes, in any media now or in the future, without compensation.  We always ask for permission first.

7. Assumption of Risk and Release of Liability

In consideration of being permitted to participate in FIT HQ, LLC (MYLF COACHING) services, you acknowledge and agree:

Participation in physical activities involves inherent risks, including but not limited to muscle strains, falls, cardiac events, or other injuries.

You assume full responsibility for any risks, injuries, or damages incurred as a result of your participation.

You release and hold harmless FIT HQ, LLC, its owners, directors, officers, agents, employees, and representatives, including Jennifer McCormick, from any and all claims or liabilities arising from your participation, whether caused in whole or in part by negligence.

8.  Minors

If a participant is under the age of 18, they may only register for and participate in FIT HQ, LLC/MYLF Coaching programs with the consent, involvement, and supervision of a parent or legal guardian.

By registering a minor or allowing a minor to participate, the parent or legal guardian acknowledges and agrees that they are fully responsible for the minor’s participation, health, safety, decision-making, application of program materials, and communication with the MYLF coach.

MYLF Coaching programs may include nutrition education, mindset education, food logging, workouts, coaching feedback, and other health-related content. This content is intended to be educational and supportive, but it is not a substitute for parental guidance, medical advice, mental health care, or professional supervision. A parent or legal guardian is expected to actively review the content, help the minor understand and apply the information appropriately, and provide personal guidance based on the minor’s age, maturity, health, needs, and circumstances.

If a minor is participating in any coaching program, the parent or legal guardian is expected to remain actively involved and in communication with the coach as needed. FIT HQ, LLC/MYLF Coaching and its coaches are not responsible for supervising, parenting, monitoring, managing, or making decisions on behalf of any minor participant.

The parent or legal guardian assumes all risks associated with the minor’s participation and agrees to release, indemnify, defend, and hold harmless FIT HQ, LLC, MYLF Coaching, its owners, coaches, contractors, employees, and representatives from any claims, damages, injuries, losses, or liabilities arising from or related to the minor’s participation in any MYLF Coaching program, including the minor’s use or application of any educational content, coaching feedback, nutrition guidance, workouts, platform tools, or program materials.

FIT HQ, LLC/MYLF Coaching reserves the right to require parent or legal guardian involvement in coaching communication and may pause or discontinue coaching access for a minor if appropriate parental involvement is not being provided.

9. Acknowledgement at Checkout

By signing this Agreement or checking the required boxes at online checkout, you acknowledge and agree that:

You understand you are entering into a binding agreement with FIT HQ, LLC (MYLF COACHING).

You understand that all sales are final and non-refundable once program access is granted.

You understand that if paying through Affirm or another lender, you are entering into a separate loan agreement that must be repaid according to its terms.

You understand that if a minor participates in any MYLF Coaching program, the parent or legal guardian is fully responsible for the minor’s participation, supervision, communication with the coach, use of program content, health, safety, and decision-making.

You understand that MYLF Coaching and its coaches are not responsible for supervising, parenting, monitoring, or making decisions on behalf of any minor participant.

You have reviewed and accepted these Terms and Conditions in full.
